Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Fish & Tides mobile application and website (collectively, the "Service"), developed and operated by Rivolu LLC ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms and by Apple's standard Licensed Application End User License Agreement referenced in Section 1 below. If you do not agree to these Terms, do not use the Service.

1. License to Use the App (Apple EULA)

Your license to download, install, and use the Fish & Tides iOS application is granted under Apple's standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ (the "Apple EULA"). The Apple EULA is a binding agreement between you and Rivolu LLC, and it governs the scope of your license, permitted uses, restrictions on reverse engineering, consent to use of diagnostic data, termination of the license, export compliance, warranty disclaimers, and limitation of liability with respect to the App itself.

You acknowledge and agree to the following, as required by the Apple EULA:

• These Terms and the Apple EULA are concluded between you and Rivolu LLC, and not with Apple. Apple is not a party to these Terms.
• Apple has no obligation whatsoever to provide any maintenance or support services with respect to the App.
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your use of the App, including (but not limited to) product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
• You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with applicable third-party terms of agreement when using the App (for example, your wireless data service agreement).
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

If there is any conflict between the Apple EULA and these Terms in relation to your license to use the App, the Apple EULA will prevail with respect to that license. These Terms govern all other matters — including the Fish & Tides Service features, subscription terms, user-generated content, data accuracy disclaimers, and our use of your personal information — as described below.

2. Acceptance of Terms

By using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Service

Fish & Tides provides fishing forecasts, a 0–100 fishing score, tide and currents charts, weather data, solunar predictions, catch logging with photos, trip tracking, species intelligence, a fishing map with points of interest, gamification (XP, badges, 15 gemstone leagues, weekly challenges, skill-tiered leaderboards), and optional local notifications for your daily forecast and bite-window alerts — all for informational and recreational purposes only.

The Service displays tide data sourced from NOAA (United States), the UK Hydrographic Office (United Kingdom), and the Bureau of Meteorology (Australia); weather and marine data from the U.S. National Weather Service (NWS) and Open-Meteo; and water-level data from the U.S. Geological Survey (USGS).

4. Free Access and Pro Subscriptions

4.1 Free Access

Today's fishing forecast, tide chart, and weather chart are free to view without an account. Catch logging, species intelligence, and the referral program require a free account.

4.2 Pro Features

Pro unlocks the full 10-day forecast, extended species intelligence, and other advanced features. Pro is sold as an auto-renewing subscription through the Apple App Store. Paywalls and offers within the App may be managed by our paywall provider Superwall, but all purchases are processed by Apple.

4.3 Earning Pro by Referral

You may earn free Pro time by inviting friends. When a friend joins using your referral code, you receive one month of free Pro plus bonus XP, and your friend also receives one month of free Pro. Free Pro earned through referrals does not auto-renew and does not extend beyond the awarded period.

4.4 Billing

Payment for Pro is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

4.5 Managing Your Subscription

You can manage or cancel your Pro subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial billing periods, except as required by law.

4.6 Price Changes

We reserve the right to change Pro subscription prices. Any price change will take effect at the start of the next subscription period following the date of the price change. Your continued use of Pro after the price change constitutes your agreement to pay the updated amount.

5. User Accounts and Content

5.1 Accounts

Today's forecast, tides, and charts are viewable without signing in. To use catch logging, species intelligence, or the referral program, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5.2 User-Generated Content

You retain ownership of the catches, photos, trips, and other content you submit to or through the Service ("User Content"). By submitting User Content, you grant Rivolu LLC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully-paid, sublicensable, and transferable license to host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and otherwise use and exploit your User Content in connection with the operation, improvement, development, and promotion of the Service and related products and services. This license survives termination of your account with respect to User Content that has been aggregated with other data, de-identified, or incorporated into derivative works.

You represent and warrant that you own or have the necessary rights to any User Content you submit, and that your User Content does not infringe on the rights of any third party.

5.3 User Content Standards

Prohibited User Content. You agree not to upload, submit, or store any User Content through the Service that:

• Is unlawful, fraudulent, harassing, threatening, defamatory, obscene, hateful, or invasive of another person's privacy;
• Infringes any copyright, trademark, trade secret, or other intellectual property right of a third party;
• Reveals the private information of another person — including their home address, personal identity, or other personally identifying details — without their explicit permission;
• Promotes illegal fishing activity, poaching, the harvest of protected or endangered species, the use of prohibited gear or methods, or any violation of applicable fishing regulations;
• Contains malware, phishing links, viruses, or any other malicious code;
• Contains nudity, sexually explicit material, or graphic violence;
• Interferes with or disrupts the Service.

Our right to moderate and remove. We reserve the right, but are under no obligation, to review, monitor, moderate, edit, remove, or disable any User Content at any time, in our sole discretion, with or without notice, for any reason or no reason — including User Content that we believe violates these Terms or applicable law, or that we consider harmful, objectionable, or otherwise inappropriate. We may also issue warnings; suspend, limit, or permanently terminate your account; block your access to the Service; or refuse future service if you violate these Terms or repeatedly submit content that violates them.

No obligation to pre-screen. We do not pre-screen or approve User Content before it is stored in the Service. You acknowledge that Rivolu is not responsible for the accuracy, authenticity, completeness, or legality of User Content, and that the user who submitted it is solely responsible for it.

Retention of removed content. If we remove, disable, or moderate any of your User Content, we may retain copies of it — along with associated account and device metadata — for a reasonable period to investigate abuse, enforce these Terms, respond to legal or regulatory requests, or for other legitimate business purposes, even after the content is no longer accessible in the Service.

Reporting a concern. If you encounter User Content that violates these Terms, or if you are the subject of User Content that you believe infringes your rights, please report it to us at admin@rivolu.com with a description of the content and the reason for your concern. We review reports in good faith but do not guarantee that any specific action will be taken on any individual report.

5.4 Analysis, Research, and Derived Data

You acknowledge and agree that we may analyze information you submit to or generate through the Service — including catches, trips, photos, environmental conditions at the time of each entry, and related metadata — to operate and improve the Service, develop new features, products, and services, conduct research and statistical analysis, and train, evaluate, and refine algorithms and predictive models. We may retain and use aggregated, anonymized, or de-identified data and the insights, models, benchmarks, and forecasts derived from it for any lawful purpose without restriction, including offering such data, insights, or forecasts as separate products or services provided by us or our partners. Our use of aggregated and de-identified data is further described in our Privacy Policy.

5.5 Copyright Infringement (DMCA Notices)

Rivolu LLC respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to notices of alleged copyright infringement that are reported to our designated copyright agent.

If you believe that material posted on or through the Service infringes a copyright you own or control, please send a written notice to our designated agent that includes all of the following, as required by 17 U.S.C. § 512(c)(3):

• A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
• Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works;
• Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or have access to it disabled, and information reasonably sufficient to permit us to locate the material (for example, a link or in-app location of the post);
• Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address;
• A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
• A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

If we remove or disable access to User Content in response to a DMCA notice, we will make reasonable efforts to notify the user who posted the content so that they may submit a counter-notification under 17 U.S.C. § 512(g). A valid counter-notification must include the user's signature, identification of the removed material and its prior location, a statement under penalty of perjury that the user has a good-faith belief that the material was removed as a result of mistake or misidentification, the user's name and contact information, and the user's consent to the jurisdiction of the federal district court for the judicial district in which the user resides (or, if outside the United States, any judicial district in which Rivolu LLC may be found).

It is our policy, in appropriate circumstances and at our discretion, to terminate the accounts of users who are repeat copyright infringers, in accordance with 17 U.S.C. § 512(i).

6. Disclaimer of Accuracy

Fishing forecasts, tide predictions, current predictions, weather data, and solunar data displayed in the Service are based on predictions and forecasts from third-party sources. This data is provided "as is" without warranty of any kind. Predictions do not account for the full effects of wind, storms, rain, freshwater runoff, floods, or other meteorological events that may affect actual conditions on the water.

Do NOT use Fish & Tides for navigation purposes or for any other purpose that may result in personal injury or property damage. Always follow local fishing regulations, obtain required licenses, and exercise caution on the water.

7. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or fishing regulation;
• Attempt to reverse engineer, decompile, or disassemble the App (beyond what is permitted by the Apple EULA or applicable law);
• Interfere with or disrupt the Service or servers or networks connected to it;
• Redistribute, sublicense, or resell the Service or any data obtained through it;
• Use the Service in any manner that could damage, disable, or impair it;
• Submit false catch reports or any content intended to harass or defraud others.

8. Third-Party Services

The Service integrates with or depends on third-party services that are not owned or controlled by Rivolu LLC, including Apple's App Store, StoreKit, Apple Sign-In, and MapKit; Superwall (paywall and subscription display); Railway (backend hosting); Amazon Web Services S3 (photo storage); and the public data APIs of NOAA, NWS, USGS, UKHO, BOM, and Open-Meteo. We assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party services.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

10. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. The Apple EULA is governed by its own choice-of-law provisions and is not affected by this Section.

12. General Provisions

12.1 Indemnification

You agree to defend, indemnify, and hold harmless Rivolu LLC, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your access to or use of the Service; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; or (d) any User Content you submit, post, or otherwise make available through the Service.

12.2 Service Availability and Modifications

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. We reserve the right to modify, suspend, or discontinue any feature, component, or portion of the Service — including the free or Pro tiers, individual data sources, or entire features — at any time, temporarily or permanently, with or without notice, and without liability to you or any third party.

12.3 Force Majeure

Rivolu LLC will not be liable for any failure or delay in the performance of its obligations under these Terms that is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, power or network outages, cyberattacks, or the acts or omissions of third-party service providers such as Apple, Railway, Amazon Web Services, Superwall, or any government data agency.

12.4 Entire Agreement

These Terms, together with the Apple EULA referenced in Section 1 and our Privacy Policy, constitute the entire agreement between you and Rivolu LLC regarding your use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and Rivolu LLC with respect to the Service.

12.5 Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect.

12.6 No Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver by us of any breach or default under these Terms shall be deemed a waiver of any preceding or subsequent breach or default.

12.7 Assignment

You may not assign or transfer these Terms, in whole or in part, by operation of law or otherwise, without our prior written consent. Any attempted assignment in violation of this provision shall be null and void. We may freely assign or transfer these Terms, in whole or in part, without restriction, including to any affiliate, successor, or acquirer of our business or assets.

12.8 Electronic Communications and Notices

By using the Service, you consent to receive communications from us electronically — including notices of changes to these Terms, legal notices, updates, and administrative messages — through the App, by email, or by posting to our website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Legal notices to Rivolu LLC must be sent to admin@rivolu.com. DMCA copyright notices should follow the procedure set out in Section 5.5.

12.9 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.
